DRG Reporting Web Application Now Available [UPDATE: DRG Reporting for calendar year 2022 has ended]
The Nebraska Workers’ Compensation Court has activated its web-based data entry application for Diagnostic Related Group (DRG) reports. This report summarizes information electronically reported to the court by employers and insurers for work-related injuries and illnesses that occurred during calendar years 2017 through 2021, regardless of the year the injury reports were filed. The court is engaged in ongoing efforts to refine the quality of data reported, working with those who report the data to improve its quality. NEWS RELEASE: Hastings Processing Plant Found Guilty of Criminal Violations of Nebraska Workers’ Compensation Act
On April 7, 2022, Noah’s Ark Processors LLC of Hastings, Nebraska, was found guilty on three criminal charges for failing to file required injury reports with the Nebraska Workers’ Compensation Court. The criminal charges were brought by the Nebraska Attorney General pursuant to NEB. REV. STAT. § 48-144.04. - In light of recent trends surrounding the spread of the novel coronavirus and the COVID-19 disease, the Administrative Order of the Nebraska Workers’ Compensation Court dated August 11, 2021 is rescinded. The Nebraska Workers’ Compensation Court will continue to follow and comply with the terms of the Administrative Order of the Supreme Court of Nebraska dated August 9, 2021.
- As a general rule, masks are not required to be worn by any attorney, party, witness, participant, or observer attending any trial or hearing in the Nebraska Workers’ Compensation Court. However, this order does not prevent implementation of protective measures to prevent the transmission of illness in any hearing or trial of the Nebraska Workers Compensation Court.

Rule amendments adopted at December 16, 2021 public meeting
Amendments to Rules 2, 3, 9, 12, 63, and 64 were adopted at a public meeting on December 16, 2021. Amendments to non-adjudicatory Rules 63 and 64 are effective as of December 16, 2021. The court also adopted the proposed amendments to the Diagnostic-Related Group (DRG) Inpatient Fee Schedule found in Rule 26, which are effective as of January 1, 2022. The court did not act upon proposed amendments to Rule 26 concerning the Schedules of Fees for Medical, Surgical, and Hospital Services. Amendments to adjudicatory Rules 2, 3, 9, and 12 will become effective only upon review and approval by the Nebraska Supreme Court. The court did not adopt the proposed new Rule 14.

- The Nebraska Workers’ Compensation Court will follow and comply with the terms of the Administrative Order of the Supreme Court of Nebraska dated August 9, 2021.
- Individuals who are fully vaccinated against COVID-19 may appear in the Nebraska Workers’ Compensation Court without a face covering (cloth mask or plastic shield) and individuals who are not fully vaccinated against COVID-19 are asked to wear a face covering when appearing in the Nebraska Workers’ Compensation Court for any in-person proceeding. During an in-person trial or in-person legal proceeding, the attorney or self-represented litigant asking questions of a witness and the witness who is testifying are permitted to remove their face covering while asking questions or testifying.
- The Administrative Order of the Nebraska Workers’ Compensation Court dated May 25, 2021 is rescinded.

- In light of the positive trends in both COVID-19 cases and vaccinations in the State of Nebraska and given the absence of any mask mandate within the State of Nebraska, the Administrative Order dated November 10, 2020 (renewed by Administrative Order dated December 28, 2020) is rescinded.
- Individuals who are vaccinated against COVID-19 disease may appear in the Nebraska Workers’ Compensation Court without a mask.
- Individuals who are not vaccinated against COVID-19 disease are asked to please wear a mask when appearing in the Nebraska Workers’ Compensation Court.

New Nature of Injury Code for Adverse Reaction to Vaccination
A new Nature of Injury Code (DN0035) — 38 for “Adverse reaction to a vaccination or inoculation” was approved recently by the Workers’ Compensation Insurance Organizations (WCIO) and recommended by the International Association of Industrial Accident Boards and Commissions (IAIABC).
The Nebraska Workers’ Compensation Court (NWCC) will be ready to accept the new code effective March 8, 2021, in accordance with Neb. Rev. Stat § 48-144 and Workers’ Comp. Ct. R. of Proc. 29 and 30. Electronic Data Interchange (EDI) requirement tables updated with the new codes constitute the form and manner and include the content prescribed and approved by the NWCC court administrator.

Use of this temporary email address should be limited to that purpose and is intended only for notifications made outside normal business hours. During business hours, the judge’s assistant should be contacted.

REMINDER: Effective October 1, 2020, the Nebraska Workers’ Compensation Court will change its hours of operation. The new office hours, applicable for all of the court’s facilities in Lincoln and Omaha, begin at 8:00 a.m. and end at 4:30 p.m., Monday through Friday.

This statistical report summarizes information reported to the Nebraska Workers’ Compensation Court by employers and insurers for work-related injuries and illnesses that occurred during calendar years 2015 through 2019, regardless of the year in which the reports were filed. Data for previously reported calendar years is divided into subcolumns that illustrate how data changes over time as a result of late reporting and corrections. A message to attorneys regarding trials in the Nebraska Workers’ Compensation Court
- Is this case ready for trial or is it clear a continuance is going to be needed? If you and opposing counsel agree that a continuance is needed, please contact the judicial assistant of the trial judge and inform her that a continuance will be requested. This saves our court time trying to find a courtroom.
- Is my client willing to move this trial to Lincoln or Omaha if there is not a courtroom available in the county courthouse where the case is venued? Discuss this possibility with your client and opposing counsel. Please let the judicial assistant know if the parties are willing to move the trial to another county in the event there is no access to the venued courthouse.
- Is my client willing to move this trial to a nearby venue if there is not a courtroom available in the county courthouse where the case is venued? Discuss this possibility with your client and opposing counsel. You'll need to work with the judicial assistant to see what courthouses are available.
- Is my client willing to conduct the trial by video? We use Google Meet for our video platform. It's simple and the clerk will test with everyone to ensure connectivity. You will need a computer, laptop, tablet, or smartphone with a camera and microphone. Not all parties have to appear by video. Discuss the options with your client and opposing counsel.

New Cause and Nature of Injury Codes for COVID-19 Pandemic
The Nebraska Workers’ Compensation Court (NWCC) will be ready to accept the new codes effective April 1, 2020, in accordance with Neb.Rev.Stat § 48-144 and Workers’ Comp. Ct. R. of Proc. 29 and 30. Electronic Data Interchange (EDI) requirement tables updated with the new codes constitute the form and manner and include the content prescribed and approved by the NWCC court administrator.
