Rules of Procedure, Nebraska Workers’ Compensation Court

The Nebraska Workers’ Compensation Court’s revised Rules of Procedure are now available (https://www.newcc.gov/resources/court-forms-and-publications/rules-of-procedure).

Amendments to Rules 2, 3, 5, 14, 26, 35, 47, 48 and Addenda 2 and 3 were adopted at a public meeting on December 30, 2024. A revised Schedule of Fees for Medical Services was also adopted. Amendments to non-adjudicatory Rules 26, 35, 47, and 48 became effective December 30, 2024. Amendments to adjudicatory Rules 2, 3, 5, and 14 became effective following review and approval by the Nebraska Supreme Court on January 29, 2025. Schedules of Fees for Medical Services, Inpatient Hospital Diagnostic Related Group (DRG), and Inpatient Hospital Trauma Services

Schedules of Fees for Medical Services, Inpatient Hospital Diagnostic Related Group (DRG), and Inpatient Hospital Trauma Services may be downloaded from the Fee Schedules section of the court’s website (https://www.newcc.gov/service-providers/medical-providers/fee-schedules). These schedules are effective January 1, 2025.

The Nebraska Workers’ Compensation Court to remain open on January 9, 2025

Recently Adopted Rule Amendments and Revised Schedule of Fees for Medical Services

Amendments to Rules 2, 3, 5, 14, 26, 35, 47, 48 and Addenda 2 and 3 were adopted at a public meeting on December 30, 2024. A revised Schedule of Fees for Medical Services was also adopted. Amendments to non-adjudicatory Rules 26, 35, 47, and 48 are effective December 30, 2024. Amendments to adjudicatory Rules 2, 3, 5, and 14 will become effective only upon review and approval by the Nebraska Supreme Court. NEWS RELEASE: Change in mileage reimbursement rate

Effective January 1, 2025, the mileage rate will become 70.0 cents per mile for travel to seek medical treatment or while participating in an approved vocational rehabilitation plan. See related news release (https://www.newcc.gov/home/court-news/2024-08-news).

Nebraska Supreme Court adopts amendments to Nebraska Court Rules of Discovery in Civil Cases

On November 13, 2024, the Nebraska Supreme Court adopted rule amendments to Neb. Ct. R. Disc. § 6-326 through § 6-337 governing discovery. The adopted amendments are effective January 1, 2025 for all Nebraska trial courts, including the Nebraska Workers' Compensation Court. News releases regarding the Bureau of Labor Statistics (BLS) Nebraska Survey of Occupational Injuries and Illnesses and Nebraska Census of Fatal Occupational Injuries for 2022 are now available. Any employer selected to report data for the BLS injury survey and fatality census may contact us with questions. General questions from the public are also welcomed.

NEWS RELEASE: Nebraska Workers’ Compensation Maximum Weekly Income Benefit To Increase

Effective January 1, 2025, the maximum weekly income benefit under the Nebraska Workers’ Compensation Act will increase to $1,130.00. This amount applies to work-related injuries and illnesses occurring on or after January 1, 2025 (https://www.newcc.gov/home/court-news/2024-07-news).

DRG Reporting Web Application Now Available [UPDATE: DRG Reporting for calendar year has ended]

The Nebraska Workers’ Compensation Court has activated its web-based data entry application for Diagnostic Related Group (DRG) reports. Hospitals and payors may report for themselves, or they may allow a third party to report for them (https://www.newcc.gov/service-providers/medical-providers/drg-reporting). 

Extended E-Filing system unavailability [UPDATE: E-Filing is now available]

Our E-Filing system is temporarily unavailable while we investigate an ongoing connectivity issue. Thank you for your patience while we work through this. We will bring services back up as soon as possible. 

Only in the event of an extended period longer than 24 hours where the court’s E-Filing system is not available may the user file a paper document with the court clerk. The user may make such filing by fax machine (402-471-8231). In such instances, the user is responsible for service of the document(s) on parties entitled to service pursuant to Rule 3,B. NEWS RELEASE: Nebraska Workers’ Compensation Burial Benefit To Increase

The burial benefit under the Nebraska Workers’ Compensation Act will increase to $11,600.00 effective July 1, 2024. This benefit applies upon the death of an employee, resulting through personal injuries as defined in NEB. REV. STAT. § 48-151. Select this link to read the news release.
