Rules of Procedure, Nebraska Workers’ Compensation Court

The Nebraska Workers’ Compensation Court’s revised Rules of Procedure are now available (https://www.newcc.gov/resources/court-forms-and-publications/rules-of-procedure).

Amendments to Rules 26 and 47, and Addendum 2 were adopted at a December 28, 2023 public meeting. Amendments to Rule 47 and Addendum 2 became effective December 28, 2023. Amendments to Rule 26 became effective January 1, 2024. Adopted amendments to adjudicatory Rules 5, 13, 14, and 15 were adopted at the same public meeting and became effective January 24, 2024, following review and approval by the Nebraska Supreme Court.

The Nebraska Workers’ Compensation Court has implemented electronic notice (E-Notice) following Nebraska Supreme Court approval of recently adopted amendments to its Procedural Rules 2 (Filings), 3 (Pleadings), and 11 (Decisions). E-Notice is the electronic transmission of notices, opinions, court entries, and any other dispositional orders from the court to all users who have registered for E-Filing. Please note that any “bookmarked” URL links to these web apps will need to be reset. 

Regarding the Decisions and Orders search app, applying the following settings may be useful. Once selected, these will be saved in your computer's browser cache and they won't have to be reapplied unless the cache is deleted.

  • Select "all of the words" from the drop menu to the right of the search field
  • Check the "Stemming" search option
  • Select "date" in the Sort Type drop menu

NOTICE: E-Filing System Technical Issue [Update]

The Nebraska Workers' Compensation Court continues to work with its vendor to resolve an issue with our E-Filing system. During this extended outage, attorneys may submit pleadings by fax with the exception of settlements. Settlements must be delivered in paper format accompanied by a paper check until the outage is resolved. For pleadings submitted by alternative means during the outage, the filer is responsible for service of the document(s) on parties entitled to service pursuant to Rule 3,B. Please contact us with any questions.

Effective April 26, 2023, the court’s website and email domains (website and email addresses) will change from the “wcc.ne.gov” extension to “newcc.gov.” 

Please note that some “bookmarked” links to specific pages of our website may need to be reset. Also, email address books listing Nebraska Workers’ Compensation Court personnel will need to replace the old format of “name@wcc.ne.gov” with the new format of “name@newcc.gov.” This also includes any group addresses for our court’s personnel. To keep it simple, the name part of the email address before the “@newcc.gov” will remain the same.

Workers’ Compensation Auditor Selected

The Nebraska Workers’ Compensation Court is pleased to announce Erica Ziemann as its new Workers’ Compensation Auditor, effective March 1, 2023. The auditor position is responsible for the court’s self-insurance program, which is managed by the Regulatory Programs section of the court. 

In her new role, Erica will review applications from individual employers to self-insure their workers’ compensation liability, determine and collect fees and assessments, and monitor the employers’ continued ability to meet their financial obligations under the Nebraska Workers’ Compensation Act. As self-insurance privileges are subject to periodic review and renewal, Erica will conduct periodic on-site audits of payroll records.

Decisions and Orders search capability expanded

The Decisions and Orders dtSearch-based web application can now be used to search all Nebraska Workers' Compensation Court decisions and orders going back as far as 1992. Previously, this application could only deliver 10 years' worth of search results. Some 30 years' worth of information are currently available, comprising more than 43,000 electronic files.

The reconfiguration of this web application and associated file mapping upgrade was made possible as part of the court's modernization project. As an added benefit, the application now delivers faster performance in returning search results.

The Nebraska Workers' Compensation Court adopted amendments to Rule 2, Filings, to require Nebraska attorneys to E-File all pleadings in 2023. This amendment will become effective upon review and approval by the Nebraska Supreme Court.

Deputy Clerk of the Court Selected

The Nebraska Workers' Compensation Court is pleased to announce Rachel Wulf Schmidt as its new Deputy Clerk, effective August 1, 2022. NEWS RELEASE: Hastings Processing Plant Found Guilty of Criminal Violations of Nebraska Workers’ Compensation Act

On April 7, 2022, Noah’s Ark Processors LLC of Hastings, Nebraska, was found guilty on three criminal charges for failing to file required injury reports with the Nebraska Workers’ Compensation Court. The criminal charges were brought by the Nebraska Attorney General pursuant to NEB. REV. STAT. § 48-144.04. Rules of Procedure, Nebraska Workers’ Compensation Court

The Nebraska Workers’ Compensation Court’s revised Rules of Procedure are now available (https://www.newcc.gov/resources/court-forms-and-publications/rules-of-procedure). Amendments to Rules 3, 13, 47, 64, 65, and Addendum 2 were adopted at a public meeting on June 25, 2021. Non-adjudicatory Rules 47, 64, 65, and Addendum 2 became effective June 25, 2021. Adopted amendments to adjudicatory Rules 3 and 13 became effective September 15, 2021 following review and approval by the Nebraska Supreme Court.

Notice regarding new Release of Liability option and new Release of Liability form

A new option to file a Release of Liability for workers’ compensation claims becomes available effective August 28, 2021 following the passage of Legislative Bill (LB) 256, approved by Governor Ricketts on May 21, 2021. The Nebraska Workers’ Compensation Court has developed a new pleading form to be filed for this purpose. Read the news release (https://www.newcc.gov/home/court-news/2021-6-news).

ADMINISTRATIVE ORDER: May 25, 2021 Administrative Order rescinded; mask guidance provided for appearances in the Nebraska Workers’ Compensation Court

  • The Nebraska Workers’ Compensation Court will follow and comply with the terms of the Administrative Order of the Supreme Court of Nebraska dated August 9, 2021.
  • Individuals who are fully vaccinated against COVID-19 may appear in the Nebraska Workers’ Compensation Court without a face covering (cloth mask or plastic shield) and individuals who are not fully vaccinated against COVID-19 are asked to wear a face covering when appearing in the Nebraska Workers’ Compensation Court for any in-person proceeding. During an in-person trial or in-person legal proceeding, the attorney or self-represented litigant asking questions of a witness and the witness who is testifying are permitted to remove their face covering while asking questions or testifying.
  • The Administrative Order of the Nebraska Workers’ Compensation Court dated May 25, 2021 is rescinded.

DRG Reporting Web Application Now Available [UPDATE: DRG Reporting for calendar year has ended]

The Nebraska Workers’ Compensation Court has activated its web-based data entry application for Diagnostic Related Group (DRG) reports. Hospitals and payors may report for themselves, or they may allow a third party to report for them (https://www.newcc.gov/service-providers/medical-providers/drg-reporting).

Rule amendments adopted at June 25, 2021 public meeting

Amendments to Rules 3, 13, 47, 64, 65, and Addendum 2 were adopted at a public meeting on June 25, 2021. Non-adjudicatory Rules 47, 64, 65, and Addendum 2 became effective June 25, 2021. Nebraska Workers’ Compensation Court to remain open on June 18, 2021

The Nebraska Judicial Branch recognizes the Juneteenth holiday declaration. However, all Nebraska courts and probation offices, including the Nebraska Workers Compensation Court, will remain open on June 18, 2021. ADMINISTRATIVE ORDER: November 10, 2020 Administrative Order rescinded; mask guidance provided for appearances in the Nebraska Workers’ Compensation Court

  • In light of the positive trends in both COVID-19 cases and vaccinations in the State of Nebraska and given the absence of any mask mandate within the State of Nebraska, the Administrative Order dated November 10, 2020 (renewed by Administrative Order dated December 28, 2020) is rescinded.
  • Individuals who are vaccinated against COVID-19 disease may appear in the Nebraska Workers’ Compensation Court without a mask.
  • Individuals who are not vaccinated against COVID-19 disease are asked to please wear a mask when appearing in the Nebraska Workers’ Compensation Court.

This statistical report summarizes information reported to the Nebraska Workers’ Compensation Court by employers and insurers for work-related injuries and illnesses that occurred during calendar years 2016 through 2020, regardless of the year the reports were filed.
